Peer to Peer Trade Rules

PEER TO PEER TRADE RULES

 

The following peer to peer rules apply to all categories, including individual and corporate members. A Member who puts up an ad agrees and undertakes to comply with the peer to peer shopping rules, membership and user agreements and the rules specified in the List of Prohibited Products set forth hereunder.  


1. DEFINITIONS

 

WEBSITE: A website comprised of the domain name www.digoclub.com.au and subdomain names affiliated with this domain name, all rights of which are owned by the Company.  

 

MOBILE APPLICATION: The Digoclub software, all rights of which are owned by the Company, and which runs on smartphones, tablets and similar mobile devices. This software can be obtained from online stores such the Apple App Store or Google Play. The software available on these stores, named Digoclub, registered in the name of Digital Goods Club PTY. LTD., meets the necessary security requirements. The Company assumes no responsibility for any error, including security-related errors, arising from the installation of software that was obtained through other means. 

 

DIGOCLUB: The Website and the Mobile Application are both referred to as “Digoclub”.


MEMBER: Refers to the natural or legal persons who; create their own content with the products and/or services listed on the approved user account that they created, put the Product up for sale, become members of Digoclub under the terms and conditions set forth in the Membership Agreement, and benefit from the other services provided by Digoclub. The requirements for membership are detailed in the Membership Agreement. The type of Digoclub membership may be either individual or corporate.


SELLER: Refers to a natural or legal person who becomes an individual or corporate member of Digoclub and sells their own Product to the Buyer. It is mandatory to become a Digoclub member to become a seller. Pursuant to this agreement, the USER agrees that they are over 18 years old and of legal age according to the relevant laws of Australia. The necessary requirements for membership are detailed in the Membership Agreement.


BUYER: Refers to a natural or legal person who becomes an individual or corporate member of Digoclub and purchases the products of Digoclub or the Seller. It is mandatory to become a Digoclub member to become a buyer. Pursuant to this agreement, the USER agrees that they are over 18 years old and of legal age according to the relevant laws of Australia. The necessary requirements for membership are detailed in the Membership Agreement.


PRODUCT: Refers to the products and services that were provided through Digoclub, by 3rd parties with whom Digoclub has a dealership agreement, and that are put up for sale by the Sellers, in accordance with the List of Prohibited Products, this agreement, the Conditions of Use, the Membership Agreement and other annexes. These products are not physical in nature. They are essentially E-PIN / Electronic Pins, consisting of an instantly consumed numerical code and in-game currency. The Product may hereinafter also be referred to as E-PIN.


SHOWCASING and BOOSTING: An ad featuring service, which is purchased specifically for the relevant ad, subject to an additional fee, in order for the relevant ad to reach a higher number of users. 

  

2. GENERAL PROVISIONS

 

2.1. Digoclub is the “Intermediary Service Provider” who acts as an intermediary in the execution of the distance contract for the sub-service. Digoclub has no responsibility with regards to the products of its sellers.

 

2.2. Non-members cannot post ads on Digoclub.

 

2.3. It is free to post an ad on Digoclub. However, the Showcasing and Boosting services to be used for the relevant ad will be subject to an extra charge. 

 

2.4. The Seller agrees and represents in advance that, they have read and understood these Advertising Rules and the List of Prohibited Products set forth herein before posting an ad, and that the ad they wish to create is not in violation of these rules.

 

2.5. The Seller agrees and represents in advance that, the ad is; not in violation of intellectual property rights in any way, that the product for which the ad was posted belongs to them, that the subject of the ad is not included in the List of Prohibited Products, nor is it in violation of the rules of public decency, that the product in the ad is ready for sale, the content used for the ad is relevant to the product that the Seller wishes to sell, that the product is in working condition and is always kept up-to-date.

 

2.6. All the responsibility related to the ad belongs to the Seller, and Digoclub assumes no responsibility in any way. Digoclub gives no warranty for the product in the ad.  

 

2.7. When deemed necessary, the contents of the ad may be changed by Digoclub without further notice to the Seller.

 

2.8. Ads that are too underpriced or overpriced may be removed or suspended indefinitely by Digoclub to protect the market competition and prevent unlawful profit gains. The Seller may be asked to adjust the ad’s content.

 

2.9. Digoclub may request additional information such as the copy of the passport, residence certificate, tax certificate, driver’s license owned by the Seller in order to publish the ad.

 

2.10. It is not allowed to post a second ad for the same product. These ads are considered repetitive and removed from the system without notifying the Seller. The Seller may not claim any loss of rights on account of the removal of a repetitive ad. The prior payments made by the Seller for repetitive ads will not be returned.  

 

2.11. It is prohibited to add a link to a product on another platform or to another web address in order to redirect the Buyer to another platform or to advertise another company or product. The Seller may not share their personal contact information within the ad, including but not limited to a mobile phone number or an e-mail address owned by them.

 

2.12. The prices of the additional ad services on Digoclub are based on Australian Dollars. Ads cannot be based on a foreign currency. The prices include GST.

 

2.13. The Showcasing and Boosting services that are subject to additional fees are only valid for the relevant ad. They cannot be used for another ad.

 

2.14. If the product on the ad is sold before the advertising period expires, the remaining advertising period, the Showcasing and Boosting service cannot be used for another ad or transferred to another ad.  

 

2.15. The Showcasing and Boosting fees paid for the ad will not be returned in any way after the relevant ad is posted on Digoclub.

 

2.16. The prices of the Showcasing and Boosting services are posted on the www.digoclub.com.au website and the Seller agrees and represents in advance that they are aware of these prices. Digoclub may change the prices of the ad services at any time without further notice. The changes take effect as soon as they are posted on the www.digoclub.com.au web address.  

 

2.17. Any procedure, action and use that is considered criminal as per the current legislation including but not limited to correspondences on advertising, unfair competition, terrorism, money laundering, the republic, the state, religion, racism, narcotics, politicians or other legal entities, use of pornographic content, slang words and content that is abusive towards other gamers or offensive to the spiritual memory of prominent statesmen are prohibited and against these Advertising Rules.

 

2.18. Ads that are found to be in violation of the list of prohibited products that is specific to this website and the list of prohibited products under the Australian Consumer Law may be removed or suspended indefinitely or for a definite period by Digoclub without notifying the Seller. It should be noted that, for ads that are in violation of the Australian Consumer Law, pecuniary and administrative penalties may be imposed by official authorities. As Digoclub, we are obligated to notify official authorities of these sellers. In this case, the Seller agrees and represents in advance that, they will not be entitled in any way to claim the reimbursement of the additional Showcasing and Boosting fees they paid after creating the ad. 

 

2.19. The necessary explanation will be provided to the Seller, whose ad was removed or suspended, by Digoclub within 48 hours upon the Seller’s request. The Seller will raise any objections related to the ad by creating a ticket through the Support System ([email protected]). No objections created outside of the Support System will be processed under any condition.

 

2.20. For the transactions between the Buyer and the Seller to be recorded and presented to judicial authorities as evidence when necessary, the Buyer and the Seller agree and represent in advance that they will carry out all their transactions, including but not limited to instant messaging, through the Digoclub system. Digoclub may not be held responsible for the trade transactions to be carried out between the Buyer and the Seller outside of the Digoclub system and no requests for evidence may be made to Digoclub. 

 

2.21. The Seller agrees and represents that, the income to be generated from the sale of the product in the relevant ad will be subjected to additional fees and deductions including but not limited to the Service Fee and bank transfer fee as specified in the Digoclub website or mobile application, and that the balance amount will be deposited to their account.

 

2.22. The Seller’s lead time may not exceed the period specified when creating the ad. If the product is not delivered on time, the Seller’s ad is removed. The Seller is given an unfavorable rating. In sales transactions where the product is not delivered by the Seller, the product price deducted from the Buyer’s balance is returned to the Buyer. The Seller may post a removed ad again, however the featuring service period for such an ad will not include the period during which the ad was not online.


2.23. The Seller may not sell the same product to more than one buyer. If this is detected, the seller’s account may be closed without notice.
